     يعتبر وجود القانون نتيجة حتمية وضرورية لحياة الانسان في الجماعة، فيرتبط بأسرته منذ أن يولد، وتزداد حاجاته على امتداد عمره، فيتبادل المصالح المشتركة مع غيره تلبية لهذه الحاجات، ثم يتحدد كيانه السياسي ويتبادل الحقوق والالتزامات مع السلطة العامة القائمة على شؤون الجماعة.

     فنجد مثل هذه الروابط العائلية، المالية والسياسية لا يمكن تركها بلا تنظيم، والقانون وحده هو القادر على حكمها في شكل قواعد سلوك إجبارية تضبط النظام في الجماعة، وتحكم الروابط بين الأشخاص.  

     وتهدف دراسة مقياس التشريع إلى الإحاطة بكل يخص المقصود بالقواعد القانونية، وماهية مصادرها على وجه العموم والتشريع كمصدر رسمي أصلي للقانون خصوصا، وإن من المتعين كذلك دراسة الحق لما بين القانون والحق من تلازم.
